The owner of the online store www.thermshop.ee (hereinafter the Online Store) is Jofrap OÜ, registration code 12685109, located in Keila, Harju County.

Validity of the sales agreement, product and price Information

  • The terms and conditions of sale apply when purchasing goods from the online store.
  • The prices of products sold in the online store are indicated alongside the products. For selected services, an additional fee will be added to the price for in-home delivery of the goods.
  • The delivery fee depends on the chosen delivery method.
  • The cost of transporting goods in the ThermShop online store will be displayed during payment and on the invoice.
  • The delivery fee is displayed to the buyer during the checkout process.
  • The transportation cost of the goods will be calculated automatically. We assume that one order is intended for delivery to one address. If you wish to order goods to different addresses, you will need to make separate orders or pay for additional transportation based on the invoice provided by ThermShop.
  • Information about the product is provided directly alongside the product in the online store.
  • The images of products on the website are for illustrative purposes only.
  • If you want to pay for your goods in cash, we also offer such a payment solution. In this case, please contact us directly to purchase the product. Do not place an order through the online store. We will also issue you a cash receipt together with the goods.
  • We reserve the right to unilaterally change the terms (for example, to adjust the price of goods) and to supplement them by publishing the new terms on the website www.thermshop.ee. If you place an order before the changes to the terms take effect, the terms in effect at the time of your order will apply to you.
  • Prices are in euros and include the applicable VAT rate in Estonia.

Paperless billing

  • We use paperless invoicing in our operations, and in this regard, all documents related to invoicing (advance invoice, goods invoice, credit invoice, cash invoice) are sent to the e-mail address specified when placing the order.
  • When paying in cash upon receipt of the goods, we will send you a cash invoice to the specified e-mail address.

Order placement

  • To order goods, you need to add the desired products to the shopping cart. To complete the order, you must fill out the required fields and choose a suitable delivery method for the products. The amount due will then be displayed on the screen, which can be paid using the available payment options.
  • The contract comes into effect after the order is confirmed via phone and upon receipt of the confirmation email.
  • If the ordered goods cannot be delivered due to the end of the goods or for some other reason, the buyer will be informed of this as soon as possible and the money paid (including the costs of delivering the goods) will be returned without delay, but no later than within 14 days of sending the notice.

Delivery

  • Goods are shipped across Estonia.
  • The shipping costs are to be borne by the buyer, and the corresponding price information is displayed alongside the shipping method.
  • Domestic shipments in Estonia will reach the destination specified by the buyer according to the delivery time indicated next to the product.
  • In exceptional cases, the actual delivery time of the product may be longer than indicated online. In such situations, the customer is informed by phone or e-mail and the goods are delivered according to the agreement with the customer. If the customer wants a refund, we will return the amount paid as soon as possible, but no later than within 14 days.
  • It is also possible to pick up the goods at our office in Keila, Nooruse tn 8 or order it at various parcel machines.

Right of withdrawal

  • After receiving the order, the buyer has the right to withdraw from the contract concluded in the e-shop within 14 days.
  • The right of withdrawal does not apply if the buyer is a legal entity.
  • To exercise the 14-day right of return, the ordered goods must not be used in any way other than what is necessary to ascertain the nature, characteristics, and functioning of the goods, as permitted for testing the goods in a physical store. If the goods have been used for purposes other than what is necessary to ascertain their nature, characteristics, and functioning, or if there are signs of use or wear, the Online Store has the right to reduce the amount refunded according to the decrease in the value of the goods.
  • In order to return the goods, a statement of withdrawal from the purchase of the goods must be submitted and sent to the e-mail address info@thermshop.ee within 14 days of receiving the goods at the latest.
  • The costs of returning the goods are borne by the buyer.
  • The Online Store will refund all fees received from the buyer under the contract without delay upon receipt of the returned goods, but no later than 14 days after receiving the withdrawal declaration.
  • The Online Store may refuse to make the refund until it has received the item that is the subject of the contract or until the buyer has provided evidence that the item has been sent back, whichever occurs first.
  • If the buyer has explicitly chosen a delivery method other than the least expensive standard delivery method offered by the Online Store, the Online Store is not obligated to refund the costs that exceed those associated with the standard delivery method.
  • The Online Store has the right to withdraw from the sales transaction and demand the return of the goods if the price of the goods in the online store is mistakenly listed significantly below the market price of the goods.

Right to make a claim

  • All products have at least a two-year manufacturer’s warranty. The online store is responsible for the non-compliance of the goods sold to the buyer with the contract conditions or a defect that already existed at the time of handing over the item and that appears within two years from the handing over of the goods to the buyer. Within the first six months from the delivery of the item to the buyer, it is assumed that the defect was already present at the time of delivery of the item. It is the Webshop’s responsibility to refute the corresponding assumption.
  • If defects appear, the buyer has the right, by law, to contact the online store within two months by sending an email to info@thermshop.ee or by calling +372 56 471 844.
  • The Online Store is not responsible for defects that arise after the goods have been delivered to the buyer.
  • If the goods purchased from the Online Store have defects for which the Online Store is responsible, it will repair or replace the defective goods. If the goods cannot be repaired or replaced, the Online Store will refund the buyer all fees associated with the sales contract.
  • The Online Store will respond to consumer complaints in writing or in a form that allows for written reproduction within 15 days.

Direct marketing and personal data processing

  • The online store uses the personal data provided by the buyer (including name, phone number, address, email address, and bank details) solely for the purpose of processing the order and sending the goods to the buyer. The online store will send newsletters and offers to the buyer’s email address only if the buyer has expressed their wish by entering their email address on the website and indicated their desire to receive direct mail notifications.
  • The buyer can unsubscribe from the offers and newsletters sent via email at any time by notifying us via email or by following the instructions provided in the email containing the offers.

Disclosure of personal data to third parties

  • To assess the quality of the purchased products, the company may contact the customer via email after the order has been delivered. The customer will be asked to leave a review of the product and rate the purchased goods. For this purpose, the buyer’s email address may be shared with third parties. Jofrap OÜ uses the platform TestFreaks AB, located at Norrtullsgatan 6, 113 29 Stockholm, Sweden, to manage customer feedback.
  • If you have requested the www.thermshop.ee newsletter and submitted your e-mail address, it may be forwarded to third parties. thermshop.ee newsletter sending service is provided by UAB MailerLite, Jono Basanavičiaus g. 15, LT-03108 Vilnius, Lithuania.

Liability and Force Majeure

  • Neither party shall be liable to the other party for any delay in the performance of its obligations under these terms if such delay is caused by circumstances beyond the control of the party (force majeure).
  • We do not compensate you for any moral damage that may result from changes to delivery times, prices, and other conditions under these terms.
  • We do not compensate you for any lost opportunities arising from changes in delivery times, prices, and other conditions.
  • We are liable to you for damages caused by breaches of these terms only in the cases and to the extent specified in the laws of the Republic of Estonia.

Dispute resolution

  • If you have any complaints regarding the Online Store, they must be sent to the e-mail address info@thermshop.ee or by phone: +372 56 471 844. If the buyer and the Online Store cannot resolve the dispute by agreement, the buyer can contact the Consumer Disputes Committee. You can familiarize yourself with the procedural conditions and submit an application here. The competence of the Consumer Disputes Committee is to resolve disputes arising from the contract concluded between the buyer and the Online Store. The review of the buyer’s complaint by the Commission is free of charge. If you are not satisfied with the answer you received regarding the goods or services you ordered, you can make a request to the European Commission for Online Dispute Resolution http://ec.europa.eu/odr/ and inform us about it. Above all, we try to resolve disagreements and disputes through negotiations. Both you and we have the right to apply to the Consumer Protection Board or the Estonian state court for the protection of your rights.
  • In matters not regulated by these terms, we will follow the legislation of the Republic of Estonia and other legal acts that govern the relationship between us.
