Validity of the Sales Agreement, Product, and Price Information
The terms and conditions of sale apply when purchasing goods from the online store.
The prices of products sold in the online store are indicated alongside the products. For selected services, an additional fee will be added to the price for in-home delivery of the goods.
The delivery fee depends on the chosen delivery method.
The delivery fee is displayed to the buyer during the checkout process.
Information about the product is provided directly alongside the product in the online store.
Prices are in euros and include 22% VAT.
Paperless Billing
We implement paperless billing in our operations, and therefore all billing-related documents (pro forma invoice, product invoice, credit invoice) are sent to the email address specified at the time of order placement.
When paying for goods upon receipt, either in cash or by card directly to the courier, the courier will also send an electronic payment confirmation and invoice to the email address provided during order placement.
Order Placement
To order goods, you need to add the desired products to the shopping cart. To complete the order, you must fill out the required fields and choose a suitable delivery method for the products. The amount due will then be displayed on the screen, which can be paid using the available payment options.
The contract comes into effect after the order is confirmed via phone and upon receipt of the confirmation email.
If the ordered goods cannot be delivered due to the item being out of stock or for any other reason, the buyer will be notified as soon as possible, and the paid amount (including delivery costs) will be refunded promptly, but no later than 14 days from the date of notification.
Delivery
Goods are shipped across Estonia.
The shipping costs are to be borne by the buyer, and the corresponding price information is displayed alongside the shipping method.
Domestic shipments in Estonia will reach the destination specified by the buyer according to the delivery time indicated next to the product.
In exceptional cases, the actual delivery time of the product may be longer than stated online. In such situations, the customer will be notified via phone or email, and the goods will be delivered according to the agreement with the customer.
Right of Withdrawal
After receiving the order, the buyer has the right to withdraw from the contract concluded in the online store within 14 days.
The right of withdrawal does not apply if the buyer is a legal entity.
To exercise the 14-day right of return, the ordered goods must not be used in any way other than what is necessary to ascertain the nature, characteristics, and functioning of the goods, as permitted for testing the goods in a physical store.
If the goods have been used for purposes other than what is necessary to ascertain their nature, characteristics, and functioning, or if there are signs of use or wear, the Online Store has the right to reduce the amount refunded according to the decrease in the value of the goods.
To return the goods, a declaration of withdrawal from the purchase must be submitted, the form of which can be found here: withdrawal form. This must be sent to the email address info@thermshop.ee no later than 14 days from the receipt of the goods.
The costs of returning the goods are borne by the buyer.
The Online Store will refund all fees received from the buyer under the contract without delay upon receipt of the returned goods, but no later than 14 days after receiving the withdrawal declaration.
The Online Store may refuse to make the refund until it has received the item that is the subject of the contract or until the buyer has provided evidence that the item has been sent back, whichever occurs first.
If the buyer has explicitly chosen a delivery method other than the least expensive standard delivery method offered by the Online Store, the Online Store is not obligated to refund the costs that exceed those associated with the standard delivery method.
The Online Store has the right to withdraw from the sales transaction and demand the return of the goods if the price of the goods in the online store is mistakenly listed significantly below the market price of the goods.
Right to Make a Claim
All products come with a two-year manufacturer’s warranty. The Online Store is responsible for any non-conformity or defect in the goods sold to the buyer that was present at the time of delivery and that becomes apparent within two years from the delivery of the goods to the buyer. Within the first six months after delivery, it is presumed that the defect was present at the time of delivery. The burden of proof to refute this presumption lies with the Online Store.
If defects appear, the buyer has the right, by law, to contact the online store within two months by sending an email to info@thermshop.ee or by calling +372 56 471 844.
The Online Store is not responsible for defects that arise after the goods have been delivered to the buyer.
If the goods purchased from the Online Store have defects for which the Online Store is responsible, it will repair or replace the defective goods. If the goods cannot be repaired or replaced, the Online Store will refund the buyer all fees associated with the sales contract.
The Online Store will respond to consumer complaints in writing or in a form that allows for written reproduction within 15 days.
Direct Marketing and Personal Data Processing
The online store uses the personal data provided by the buyer (including name, phone number, address, email address, and bank details) solely for the purpose of processing the order and sending the goods to the buyer. The online store will send newsletters and offers to the buyer’s email address only if the buyer has expressed their wish by entering their email address on the website and indicated their desire to receive direct mail notifications.
The buyer can unsubscribe from the offers and newsletters sent via email at any time by notifying us via email or by following the instructions provided in the email containing the offers.
Disclosure of Personal Data to Third Parties
To assess the quality of the purchased products, the company may contact the customer via email after the order has been delivered. The customer will be asked to leave a review of the product and rate the purchased goods. For this purpose, the buyer’s email address may be shared with third parties. Jofrap OÜ uses the platform TestFreaks AB, located at Norrtullsgatan 6, 113 29 Stockholm, Sweden, to manage customer feedback.
If visitors have subscribed to the thermshop.ee newsletter and provided their email address, it may be shared with third parties. The newsletter service for uusuni.ee is provided by UAB MailerLite, located at Jono Basanavičiaus g. 15, LT-03108 Vilnius, Lithuania.
Dispute Resolution
If the buyer has any complaints regarding the Online Store, they should send them to the email address info@thermshop.ee or call +372 56 471 844. If the buyer and the Online Store are unable to resolve the dispute through agreement, the buyer may contact the Consumer Disputes Committee. The procedural conditions can be reviewed, and a complaint can be submitted here. The Consumer Disputes Committee has the authority to resolve disputes arising from the contract between the buyer and the Online Store. The review of the buyer’s complaint by the committee is free of charge. If the response received regarding your ordered goods or services does not satisfy you, you may submit an inquiry to the online dispute resolution platform of the European Commission at http://ec.europa.eu/odr/ and inform us about it.
